The Subclass 186 Employer Nomination Scheme (ENS) visa is one of Australia’s most common pathways to permanent residency for skilled workers who have the support of an Australian employer.
Generally, applicants for the Subclass 186 visa must be under 45 years of age at the time of application. However, several subclass 186 age exemptions may allow eligible skilled workers over 45 to still apply for permanent residency through employer sponsorship.
Understanding whether an exemption applies can be critical for experienced professionals who are approaching or have exceeded the age limit but have valuable skills needed by Australian employers.
What Is the Subclass 186 Visa?
The Subclass 186 ENS visa allows skilled workers to obtain Australian permanent residency through nomination by an approved Australian employer.
There are three main pathways:
- Direct Entry Stream
- Transitional Stream
- Agreement Stream
Each pathway has specific requirements relating to the applicant’s occupation, qualifications, work experience, English ability, and age.
Standard Age Requirement for the Subclass 186 Visa
Most Subclass 186 applicants must be under 45 years of age when they apply.
However, some applicants may qualify for an age exemption if they meet specific criteria. These exemptions recognise that highly skilled and experienced workers may continue to provide significant value to Australian businesses and industries.
Who May Qualify for Subclass 186 Age Exemptions?
While most Subclass 186 visa applicants must be under 45 years of age, certain applicants may qualify for an age exemption based on their occupation, experience, or previous temporary visa history.
The following exemptions may apply:
Academic Applicants
An age exemption may apply if you are nominated as an academic by an Australian university.
Eligible positions include:
- University lecturer
- Faculty head
The role must be at Academic Level A, B, C, D, or E.
Scientists, Researchers and Technical Specialists
You may be eligible for an age exemption if you are nominated as a:
- Scientist
- Researcher
- Technical specialist
The position must be at ANZSCO skill level 1 or 2 and the nomination must be made by an eligible Australian scientific government agency or Australian university.
Medical Practitioners in Regional Australia
Medical practitioners may qualify for an age exemption if they meet specific regional work requirements.
Applicants must generally have:
- Worked as a medical practitioner in a designated regional area of Australia for at least 2 years in the 3 years immediately before applying
- Held a Subclass 457 or Subclass 482 visa during this period
- A nominated position located in a designated regional area of Australia
High-Income Temporary Sponsored Workers
An age exemption may also apply if you have held a Subclass 457 or Subclass 482 visa and:
- Worked in eligible sponsored employment for at least 2 years during the 3 years immediately before applying
- Earned at least the Fair Work High Income Threshold for each year during that period
This exemption recognises experienced temporary sponsored workers who have demonstrated ongoing employment and high earnings in Australia.
Transitional Arrangements for Subclass 457 Visa Holders
Special transitional arrangements may apply if you held a Subclass 457 visa, or had a Subclass 457 visa application that was later approved, on 18 April 2017.
Under these arrangements, you may be eligible to apply for the Subclass 186 visa if you are under 50 years of age at the time of application.
Other Subclass 186 Requirements
Even if an applicant qualifies for an age exemption, they must still meet the other requirements of the Subclass 186 visa pathway.
These may include:
- Being nominated by an eligible Australian employer
- Working in an eligible occupation
- Meeting skills and experience requirements
- Meeting English language requirements (unless exempt)
- Meeting health and character requirements
The sponsoring employer must also demonstrate that:
- The business is actively and lawfully operating
- There is a genuine need for the nominated position
- The position meets market salary requirements
The nominated position must generally meet the required income threshold, including the Core Skills Income Threshold (CSIT) where applicable.
Why Subclass 186 Age Exemptions Matter for Skilled Workers
Australia continues to experience shortages across many industries, including healthcare, engineering, construction, and specialised professional sectors.
For experienced workers over 45, employer sponsorship may provide an opportunity to secure permanent residency where points-tested migration options may no longer be available due to age limits.
However, age exemptions are highly specific and depend on the applicant’s occupation, visa pathway, work history, salary, and individual circumstances.
